Welcome to Alder & Tail. The terms "we", "us" and "our" refer to Alder & Tail. Alder & Tail operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the "Services"). Alder & Tail is powered by Shopify, which enables us to provide the Services to you.

The terms and conditions below, together with any policies referenced in them (these "Terms of Service" or "Terms"), describe your rights and responsibilities when you use the Services.

Please read these Terms carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.

By visiting, interacting with or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms or our Privacy Policy, you should not use or access our Services.

Nothing in these Terms affects your statutory rights as a consumer under Irish or EU law.

Section 1 – Access and account

By agreeing to these Terms, you confirm that you are at least 18 years old, or the age of majority where you live, and that you have given consent for any of your minor dependents to use the Services on devices you own, purchase or manage.

To use the Services, including browsing our online store or buying any of our products, you may be asked to provide certain information, such as your email address and your billing, payment and shipping details. You confirm that all the information you provide is correct, current and complete and that you have the right to provide it.

You are responsible for keeping your account details secure and for all activity on your account. You may not transfer, sell, assign or license your account to anyone else.

Section 2 – Our products

We have made every effort to show our products accurately. However, colours and product appearance may look different depending on your device and its settings.

All product descriptions may change at any time without notice. We may discontinue any product at any time and may limit the quantities of any product we offer to any person, region or country.

Section 3 – Orders

When you place an order, you are making an offer to buy. Alder & Tail may accept or decline your order at its discretion. Your order is not accepted until we confirm it, and we must receive your payment before your order is accepted. Please check your order carefully before submitting it. Cancellations are handled in line with our Refund Policy. If we do not accept, change or cancel an order, we will try to let you know using the email address, billing address or phone number you gave us.

Returns and exchanges are handled in line with our Refund Policy.

You confirm that your purchases are for your own personal or household use and not for commercial resale, unless we have agreed a bulk order with you in writing.

Section 4 – Prices and billing

Prices, discounts and promotions may change without notice. The price charged will be the price in effect when you place your order, as shown in your order confirmation email. Prices are shown in euro (€). Shipping costs and any applicable taxes are shown at checkout before you pay. Orders delivered outside the EU may be subject to import duties or taxes charged by the destination country.

From time to time we may run promotions with their own terms. If those terms conflict with these Terms, the promotion terms will apply.

You agree to provide current, complete and accurate payment and account information for all purchases, and to update it promptly so we can complete your orders and contact you if needed.

You confirm that (i) the payment information you provide is true, correct and complete, (ii) you are authorised to use that payment method, (iii) charges you incur will be honoured by your card or payment provider, and (iv) you will pay the charges you incur at the posted prices, including shipping and any applicable taxes.

Section 5 – Shipping and delivery

All delivery times are estimates. We are not responsible for delays caused by carriers, customs or events outside our control. Our Shipping Policy explains delivery times, costs and what to do if your order is delayed or lost.

Section 6 – Intellectual property

Our Services, including all trademarks, brand names, text, images, graphics, product reviews, video and audio, and their design, selection and arrangement, are owned by Alder & Tail or its licensors and are protected by Irish, EU and international copyright, trademark and other intellectual property laws.

These Terms allow you to use the Services for your own personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store or transmit any material on the Services without our written permission.

Alder & Tail's name, logo, product names, designs and slogans are trademarks of Alder & Tail. You must not use them without our written permission. Shopify's name, logo and related marks are trademarks of Shopify. All other names and logos on the Services belong to their respective owners.

Section 7 – Optional tools

We may give you access to tools provided by third parties, which we do not monitor or control. These are provided "as is" and "as available", without any warranties or endorsement. Your use of them is at your own risk, and you should make sure you are familiar with and agree to the terms on which they are provided.

Any new features we add to the Services in future will also be covered by these Terms.

Section 8 – Third-party links

The Services may include links to websites run by third parties. We are not responsible for the content or accuracy of those websites, and you visit them at your own risk. Please review their policies before making any purchase. Questions or complaints about third-party products or services should be directed to that third party.

Section 9 – Relationship with Shopify

Alder & Tail is powered by Shopify. However, any purchase you make in our store is made directly with Alder & Tail. Shopify is not responsible for any aspect of sales between you and Alder & Tail, including any injury, damage or loss resulting from products purchased.

Section 10 – Privacy policy

All personal information we collect through the Services is handled in line with our Privacy Policy. Some personal information may also be handled under Shopify's Privacy Policy. Because our store is hosted by Shopify, information you submit is shared with Shopify and with third parties that may be located in other countries, in order to provide the Services to you. Section 11 – Feedback

If you send us ideas, suggestions, reviews or other feedback ("Feedback"), you give us a worldwide, royalty-free, perpetual licence to use, reproduce, modify, publish and display that Feedback for any purpose, including promoting our store.

You confirm that you own or have the rights to your Feedback, that it is accurate, and that it does not break any law or anyone else's rights. We may, but are not required to, monitor, edit or remove Feedback that we consider unlawful, offensive or in breach of these Terms. You are responsible for any Feedback you submit.

Section 12 – Errors, inaccuracies and omissions

Occasionally, information on our website may contain errors relating to product descriptions, pricing, promotions, shipping charges, delivery times or availability. We may correct any errors and update information, or cancel orders affected by an error, at any time, including after you have placed your order. If we cancel your order because of an error, we will refund any payment you have made in full.

You may use the Services for lawful purposes only. You must not use the Services: (a) for any unlawful or malicious purpose; (b) to break any law or regulation; (c) to infringe our intellectual property rights or anyone else's; (d) to harass, abuse, defame or harm any person, including our staff; (e) to send false or misleading information; (f) to send spam or unsolicited advertising; (g) to impersonate any person or organisation; or (h) in any way that restricts anyone else's use of the Services or could harm Alder & Tail, Shopify or other users.

You also agree not to: (a) upload viruses or other malicious code; (b) copy, resell or exploit any part of the Services; (c) collect the personal information of others; or (d) interfere with or get around any security features of the Services. We may suspend or close your account if you break these Terms.

Section 14 – Termination

We may end these Terms or your access to the Services at any time. You will remain responsible for any amounts owed up to that date. Sections that by their nature should continue after termination will continue to apply.

Section 15 – Disclaimer of warranties

Information on the Services is provided for general information only. Except as expressly stated by Alder & Tail, and to the extent permitted by law, the Services are provided "as is" and "as available", without warranties of any kind. We do not guarantee that the Services will be uninterrupted, timely, secure or error-free.

Nothing in this section affects your statutory rights as a consumer, including your right to receive goods that are of satisfactory quality, fit for purpose and as described.

Section 16 – Limitation of liability

To the fullest extent permitted by law, Alder & Tail and its partners, employees, agents and service providers will not be liable for any indirect, incidental, special or consequential loss, including loss of profits, revenue or data, arising from your use of the Services or any products bought through them.

Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be limited or excluded under Irish or EU law.

Section 17 – Indemnification

You agree to compensate Alder & Tail and Shopify for any losses, damages or claims, including reasonable legal fees, arising from (1) your breach of these Terms, (2) your breach of any law or the rights of a third party, or (3) your misuse of the Services.

Section 18 – Severability

If any part of these Terms is found to be unlawful, void or unenforceable, it will be enforced to the fullest extent permitted by law, and the rest of these Terms will continue to apply.

Section 19 – Waiver and entire agreement

If we do not enforce any right or provision of these Terms, that does not mean we have waived it. These Terms and any policies posted on our website make up the entire agreement between you and us about your use of the Services.

Section 20 – Assignment

You may not transfer your rights or obligations under these Terms without our written consent. We may transfer our rights and obligations under these Terms, provided this does not reduce your rights as a consumer.

Section 21 – Governing law

These Terms are governed by the laws of Ireland, and the Irish courts will have jurisdiction over any disputes. If you live in another EU country, you also keep any protection given to you by the mandatory consumer laws of your country, and you may bring proceedings in the courts there.

Headings are included for convenience only and do not affect the meaning of these Terms.

You can view the latest version of these Terms on this page at any time. We may update these Terms by posting changes on our website. We will tell you about any significant changes as required by law. Your continued use of the Services after changes are posted means you accept them.
